Sales fees and Instructions to Act

Instrucions to act - this requires permission from the owner of the property to act on his or her behalf in all aspects of selling a property. Gough Dutton will act as key holders and will remain so during the period until completion. in all aspects of the seeling process is is up to the owner of the property to prove ownership via producing a land registery title. Once we act on your behalf we will do everything to make the property sellable and in its best light. it will be in our remit whether to instruct other agents on your behald in neighbouring boroughs or locations that might aid the viewing process. we would split the comission as we see fit normally 50%.

If you wanted to instruct another agent this will automatically upgrade to Joint sole agency agreement. in anycase and especailly ig Gough Dutton is bought on as a second agency we will require form you the names of all instrested parties introducted you by th e first agent toavoid and selling fess complaications and to avoid you having to pay doiuble fees. This would be especially inported in regards to signing any jointly instructed terms.

Sole agency agreement - Where the Agents act on the Seller’s behalf as sole agents, the Seller will be liable to pay remuneration to the Agents, in addition to any other costs or charges agreed, if at any time unconditional contracts for sale of the property are exchanged with a Buyer introduced by the Agents during the period of their sole agency or with whom the Agents had negotiations about the property during that period, or, with a Buyer introduced by another agent during that period. The Agents will be able to claim the agreed commission for a period of 6 months after expiry of the sole agency agreement, if a Buyer, introduced during the sole agency period goes on to purchase the property within 6 months of expiry of the agreement.This Sole agency fee is offered on the terms that the Market appraisal valuation figure is agreed between the agent and the Vendor. This service is offered to purchasers who have solicitors instructed, all lease hold and/or freehold information available and with the solicitors above. Termination of sole agency - Either party can terminate a sole agency at any time by giving 2 weeks’ notice, which should be confirmed in writing.

Instructions to act 1.5% of agreed selling price

Sole agency agreement 1% of agreed selling price

Joint sole agency 2% commssion is shared amoungst agents

Jointly instructed agency 3% winning agent secures commission.

DOUBLE COMMISSION WARNING - If any other agent introduces a Buyer to the Seller during the period of the sole agency agreement, this will be regarded as an introduction by the Gough Dutton consultants

Letting fee - finding a tenant only

Preparation of Tenancy Agreement.

Preparation of an inventory of contents as per charge rates.

  • Finding fee 8% of gross rental amount per annum

In the event that a tenant introduced by the agent subsequently purchases whether before, after or during the tenancy the Owner shall pay the Agents commission at the rate of 0.00% of the entire sale price such commission to be payable to the Agent upon completion of the sale.4.If after a rental has been agreed and a deposit has been taken the Landlord should withdraw the property from the market or let the property to another tenant or sell the property, the owner will be liable for a cancellation charge payable to the Agent of £175.005.If after a rental period has expired, the Landlord and the Tenant agree to renew the contract, the fees payable will be:

  • Re-signing without management 5% upfront

  • Re-signing and management 5% upfront term certain and 5% monthly to manage

Should the Landlord and the Tenant not give notice to terminate the agreement but the Landlord allows the tenant to continue, Gough Dutton properties will levy a charge of 10% per month on total rent received by the Landlord. In the event that a change of tenant occurs whereby an original tenant leaves and a replacement tenant is found by the remaining original tenants, fees will be due in full whether found by the agent or not. There will be no refund of letting fees from the original contract. Should a new contract date be created due to letting a tenant out early, a new 12 month letting fee will be due from the date of the contract, and nore funds will be given for the contract prior.

If any works are undertaken and they are over £3000 the agents will levy an implementation and consultation charge at 10% of the cost of the works in addition to any other charges that have been agree. Any cost incurred by the agent for the forwarding of postal matters other than statements of accounts will be charged at cost to the landlord..If the agent needs to attend legal proceedings then a fee of £300 per person per day or part thereof will be due to the agent made payable by the landlord.

Management and rent collection

Preparation of Tenancy Agreement.

Preparation of an inventory of contents as printed charge rates.

  • Finding fee payable on the 1st Day of the Tenancy 8% of gross rental for the duration of the tenancy, payable in advance.

Refundable pro rata.

  • MANAGEMENT SERVICE 5% of gross rental amount per annum. 1 Inspection of property

  • Rent collection only 3% of gross rental amount per annum - property inspection £75.00 per visit.

To be present at the property for supervision of building works- £50 per hour (min charge £50)

Note: management is only chargable whilst the property has tenants. If you require property management whilst the property is

empty this will remain at 5 %. Full management includug bills and service charges paid and reglaur inspections are included.

If the agent operates on behalf of the landlord with respect to insurance claims the agent will levy a charge of 10 % of the total claim in addition to any other chargesthat have been agreed.
